Terms and Conditions for the processing of personal data of natural persons

SIA “WINDO Real Estate”, Reg. No 43603086025, provides advertisement and mediation services for the real estate transactions.
If you use our services or wish to be our cooperation partner, SIA “WINDO Real Estate” may have a necessity to process your personal data.
These Terms and Conditions have been designed to provide you as a data subject with all the necessary information in relation to the Regulation of the European Parliament and Council (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter the Regulation).

1. When and on what occasions do we process your personal data?
1.1. For the execution of the agreement, for instance, to ensure the conclusion of real estate transactions, execution of the transactions and the monitoring of the transaction execution;
1.2. To ensure the proof of the facts related to the transactions in the event of disputes, claims, complaints or legal proceedings;
1.3. For the purpose of legal obligation, for instance, to ensure the execution of responsibilities provided by the legislation in relation to the identification of persons for the prevention of the legalization of illegally obtained funds;
1.4. For the purpose of legal obligation, for instance to ensure the accounting;
1.5. To ensure the protection of our legal interests and of the third parties, for instance, upon receiving the necessary legal or consulting assistance, executing the obligation to inform as provided by the legislation etc.;
1.6. To reply to the legal request of the state and municipal institutions;
1.7. To fulfil other obligations provided by the law.
We may process your data for other purposes and goals apart from the legally based only with your consent and only to the extent to which you have agreed. Such goals may include, for example, sending the proposal on the real estate.
We do not process data, which are not necessary for reaching our goal. When you decide to provide your data upon your own initiative, please carefully consider the extent of the data you provide. Do not provide us with the data on the third parties if you are not sure that you are entitled to process the data of the third parties.
The extent of the data we process may differ depending on the service you use and the terms and conditions of the transaction.

2. If you represent a legal entity receiving our services
In order to receive services of SIA “WINDO Real Estate” you provide information on your representatives and your contact persons. Prior to the disclosure of the information on your representatives and contact persons, please inform these persons on the fact that their data will be processed.
Data of the officials of the legal entities and other representatives will be used to ensure the conclusion of a planned transaction with a legal entity, execution of such transaction or communication with the legal entity (please refer to section “When and on what occasions do we process your personal data”). We will process the data of the representatives and contact persons of the legal entity in order to ensure the preparation, conclusion and execution of the transaction.

3. If you wish to view the real estate offered by SIA “WINDO Real Estate”
If you wish to view any of the real estate objects offered by SIA “WINDO Real Estate” for sale, rent or lease, SIA “WINDO Real Estate” will request you to provide information, such as your name, surname or at least the contact information in order to process your personal data for the following purposes:
3.1. To reply to your questions/ requests, for instance, to organize the view of the real estate;
3.2. To execute the agreement with the owner of the real estate – to prove the fact of visiting the property and in case you sign the agreement with the owner – to prove that you were attracted as a partner of the transaction by SIA “WINDO Real Estate”.
Your personal data will be processed for the execution of the agreement based on the legal interests, and our legal interest is to prove the owner of the real estate that we fulfil our liabilities in accordance with the mediation agreement. If you fail to provide this information, we cannot prove that there was a visit to the property, as well as we can’t prove that we showed you the real estate object.
Your data will be stored until the moment SIA “WINDO Real Estate” will need no more to prove the fulfilment of its obligations.

4. If you have given your consent for the processing of your data
You can give your consent to receive non binding information, various offers or advertising materials from SIA “WINDO Real Estate”, to participate in campaigns, questionnaires or publicity events organized by SIA “WINDO Real Estate” at any time. In such case your data will be processed based on your consent and your consent and submission of personal data is voluntary. You can withdraw your consent at any time.
If you gave consent as described above, your personal data will be stored until you withdraw your consent.
If the data processing takes place based on your consent, you may withdraw it at any time by sending a written request to SIA “WINDO Real Estate” via e-mail: info@windo.lv

5. Who will receive your personal data?
Your personal data will be used only for the provided data processing purposes and goals.
For the purpose of data processing your data may be transferred to the real estate specialists of SIA “WINDO Real Estate” and service providers, who provide services to SIA “WINDO Real Estate”, and may be involved in the execution of the obligations rising from the agreement, such as lawyers, sworn bailiffs, notaries, credit institutions, mailing service providers and other persons involved in reaching the goal of the data processing.
Your data may be given to the authorising persona if SIA “WINDO Real Estate” is processing your data due to its authorisation to represent third party based on the power of attorney.
In the cases provided by the legislation your personal data may be transferred to the state or municipal institutions or court.

6. How long will your data be stored?
Data storage term depends on the purpose, goal and legal basis for data processing.
Personal data will be processed only for the period of time it is necessary. Storage period may also depend on the terms and conditions of the signed agreement, for the needs of legal proceedings, for the legal interest of SIA “WINDO Real Estate” or third parties or applicable legal enactments (for instance laws on accounting, legal enactments on the prevention of legalization of illegally obtained funds, limitation, human rights etc.).
